TERMS AND CONDITIONS

 

 I being above age 18, or the parent of a child under the age of 18, agrees to all terms as follows:

 I acknowledge and understand that riding a minibike is a hazardous and dangerous activities that require strenuous exercise and various degrees of skill and experience for the different surfaces and venues. I understand that these activities can result in serious injury to the person and damages to property and voluntarily assume and any and all risk of loss, damage or injury while using these minibikes.

I am aware of the risks, hazards and dangers of personal injury, death and disability inherent with any and all activities possible with use of a minibike as well as those inherent risks, hazards and dangers of personal injury, death and disability in participating in any sport event. I am aware that the usual risks, hazards and dangers of personal injury and disability increases when using ramps, curbs, steps, half pipes, inclines, or declines, bowls or any other structures or device.

 I hereby agree to release and forever discharge Oz Minimoto Pty Ltd  and their agents, servants, employees, officers, directors, trustee and all other persons or entities acting on their behalf, from any and all claims, actions, damages, liability, costs or expenses and attorney fee which are related to, arise out of, or are in any way connected to my participation or use of the minibike,  use of equipment or property supplied by Oz Minimoto Pty Ltd or my presence upon the premises, whether or not such claims, actions, damages, liability, costs or expenses are caused by the negligence of the seller or the manufacturer or distributor. By this Agreement, it is my intention to surrender and waive any rights to sue or exercise any legal right to seek damages from Oz Minimoto Pty Ltd and their agents, servants, employees, officers, directors, trustee and all other persons or entities acting on their behalf.

This Agreement shall be affecting and binding upon my heirs, agents, personal representatives and assigns.

I hereby certify that I am over the age of 18 years of age. I have carefully read the foregoing and acknowledge that I understand and agree to all of the above terms and conditions. I have had the opportunity to ask any and all questions regarding this agreement and the effect of the same. I am aware that by purchasing this item and sending payment for them, I assume all risks and waive and release certain substantial rights that I may have or posses. I therefore release all liability and waive all rights I may have in regards to my child’s activities with the above item.

Legal status of products: It is the responsibility of the buyer, not the seller, to ascertain, and obey, all applicable local, state, federal and international laws in regards to the possession, and use of any item purchased from Oz Minimoto Pty Ltd. Consult your local, state and county laws before purchasing if you are in doubt. Absolutely no sales to minors. By placing and order, the buyer represents that the products ordered would be used in a lawful manner and that he/she is of legal age.  Oz Minimoto Pty Ltd will not be liable for the misuse of any products purchased from Oz Minimoto Pty Ltd or any of our distributors or agents. Should your item be confiscated by customs in your country you will NOT be refunded and you waive any rights you may have to deny your payment to us. Again, if you are in doubt check your local laws BEFORE purchasing this item.

 

You may place an order online following the online instructions or by email following these instructions.

After you have selected the parts you need from the online web site simply copy and paste the line items from the web site along with the quantity of each item into your email.  This will enable us to have a part number and full description on the items you are want to purchase. 

 

PLEASE NOTE: All orders that have not been paid for in full when using the direct payment or send a cheque method within 7days will be cancelled. You will need to re-issuse the order if you would like to proceed after this time.

 

Orders that use the credit card method are usually dispatched within 3 - 7 business days of order being placed, for instock items.

We authorize all credit card purchases with an address verification system.  This means your shipping address must have an authorize person or the purchaser to sign for acceptance of your goods.

Standard Delivery
We deliver in-stock orders by either Australia Post or TNT from our warehouse within 72 hours of acceptance of payment.

 

Small to medium orders are usually sent using Australia post by registered post.

These orders can be sent to a home, work or post box address.

If you are not at delivery address the order will be taken back to your local post office for your collection.

You will have to have proof of ownership and sign for acceptance of these orders.

 

Medium to large orders, (including bike orders), are sent using TNT express.

These orders can only be sent to a home or business address and will not be sent to a post box address.

TNT will not give you a date or time of delivery. Please issue Oz minimoto Pty Ltd a delivery address that has a authorized person to accept delivery at all times of the day. TNT will deliver the order to your nominated address and leave the order onsite regardless of you being at the delivery address or not.

 

 

THAT DELIVERY CHARGE DOES NOT INCLUDE INSURANCE. IF YOU WOULD LIKE YOUR DELIVERY INSURED A COST OF $10.00 FOR UP TO $1000.00 WOULD BE PAYABLE.

Otherwise damage to any delivery would not be a warranty claim to Oz Minimoto Pty Ltd.

 

If for some reason, you wish to cancel an order you have placed; you will need to let us know before it ships.  If an order has already been shipped and you decide to cancel, you will be responsible for all shipping charges of the item or items before a credit will be given and there will be a 15% restocking fee.  If an order is cancelled before it ships, we will gladly refund your purchase amount at that time. 

 

It is up to purchaser to make sure parts fit and are suitable for their individual application.

There are no returns or refunds on all bikes, clothing or parts once accepted by buyer. 

If a customer refuses to accept delivery of a purchase they have made, they will be responsible for "All To And From Delivery And Handling Charges" and a 15% restocking fee.  There will be no refunds until the product is received back at our facilites.

 

Any bike, part or kit is designed and manufactured for competition use only, and is sold 'as-is without warranty'.

The entire risk as to quality and performance is with the buyer.

 

Should the product arrive damaged, we will order and deliver the replacement parts to you free of charge. You must provide (upon request) visual documentation (pictures, scans, video) of the damage.  If in the event we send you a replacement part to replace a damaged part, your credit card will be charged for the new part and credited back once we receive the damaged part back if requested.

THIS WILL ONLY BE THE CASE IF THE INSURANCE OPTION IS TAKEN, AS DETAILED IN THE DELIVERY SECTION ABOVE.
 
Fraud
We will prosecute anyone attempting to make a fraudulent purchase.
 
Disclaimer
These bikes, regardless of brand or type, do pose a certain risk due to their high performance.  Even at higher speeds the front end may come up abruptly and without warning when full power is applied.  They were planned and manufactured for the purpose of riding only on a closed circuit track.

The bikes are not to be ridden on any public highway, public or crown land.

Any form of motorcycle racing is inherently dangerous it should only be attempted by competent riders wearing, at minimum, a helmet, boots, elbow and knee protection.  Any rider under 18 years of age should be accompanied by a parent or responsible adult.  Fueling up the pocketbike indicates that you accept full responsibility for the proper use and maintenance of the pocketbike, and for your own personal safety.  

All parts are to be fitted by a qualified motorbike technician.

Oz Minimoto Pty Ltd will not be responsible for incidental or consequential damages arising from or in connection with the use of any  Oz Minimoto Pty Ltd products.

A qualified motorbike technician must check over the entire bike previous to riding the bike and the bike must be maintained at all times by a qualified motorbike technician. 

All products must be fitted by a qualified motorbike technician.
